Very murky waters, Slugger , Here is another one :

I imagine that the Newmarket development , property deals etc etc involving these directors and the various companies they have interests in are all intertwined and set up in such a way that they are extremely difficult to chase in the courts. I bet that Yorkcourt 2008 for example will have zero asset value so even if they lost in court they have nothing to lose.

Of course that will be the case, hence legal action is probably pointless, the only ones that will ultimately suffer is us. Plus if the murk draws the council in as well then the very people who are the only ones that can help us now will be turned against us and that really will be that.

| I notice on the latest Daily Star article that Box says: "I believe we are left with no alternative than to call on Yorkcourt to walk away from the Wakefield and the Newmarket scheme and stop letting our residents down."
Does this not let them off the hook? It says 'walk away from the Wakefield and Newmarket Scheme', not 'walk away from Wakefield'? Pedantic maybe, but still think all this hot air from Box is just keeping up appearances.

| You'll see what the council thinks of Yorkcourt when the next planning application goes in , nothing will happen they need the jobs and some social housing.Yorkcourt can't lose , no stadium and no repercussions.

| Been away for a few days and things, regarding a new ground, seem to have taken a turn for the worse, again.
A question for those on here that are better informed on the legal side but, IF Yorkcourt have failed to keep their promises on the Community Stadium and it would certainly appear that they have, does anything prevent them from further developing the site.
At the public enquiry, the SoS stated that nothing could happen to hinder the stadium build and yet, clearly, if Yorkcourt aren't going to keep their promises, what happens to the land ?
Can they continue to develop the site as they wish or, are there mechanisms in place for WMDC to "take back" the land, possibly allowing a different developer to come in ?

However the person with the upper hand is Peter Box he has a great deal of power to influence what happens up there. How he will use it no one knows.

I understand what you are saying and I know very little about buying/selling land and developing it.
However, if Yorkcourt had/have no intention of doing what they promised, it just cannot be right for them to carry on regardless, it's just wrong.

| I agree - it's "just plain wrong" but sadly that's a moral judgement rather than a legal one. Yorkcourt appear to have no morals at all and I bet if the council try to hold up/deny planning permission/penalise them in any way, they will be straight to the High Court to sue the council. Given the complex nature of the companies and directors I reckon they have everything covered so they never lose financially. They don't seem to care about their reputation. From previous posts it appears that the land for the ground is owned by the farmer with Yorkcourt having an option to buy. I'd love to know how that "option" is framed. Who has the "option"? I bet it's Yorkcourt's and the farmer and council will have no say. Again I bet that the agreement stops the farmer selling to anyone else e.g. the council or the club. They will have it all sewn up nice and tidy.

| It's a complete farce, I just don't get how PB's mind works, unless he's up to his neck in the brown stuff with Yorkcourt.
So my conclusion, we have a business in Yorkcourt that promised to build a community stadium once trigger points were hit, they managed to swerve past the trigger point with help from Rodders and the council resulting in no community facilities being built and YC just walking away having built nothing for the people of Wakefield!
We then get to this week and the Heads of terms single page paper outlining funk all? Our glorious leader PB then gets on his high horse, he's gonna "give them what for", he decides we've been let down ( no Sherlock) , he then suggests that Yorkcourt ought to walk away from Wakefield and Newmarket in particular. So he's saying you've not built anything for us in five years, you obviously don't intend to, on your way! Job done YC, never intended to build and not pressured to build........Cheers Peter, you showed them!
