I can, we only need to come above probably london and a.n.other. We've still got a shot. But this is a problem entirely of our own making IMHO, when we were in such dire financial straights last season we should have built a squad we could afford at the time and continue to afford in the short to medium term, clearly we didn't....and yes i know lots of the reasons and explanations why we've taken that route, but its ultimately folly to sign players we can't afford as they end up leaving after (another) admin, a week before the season. (We tried this before, build a team and the money and fans will follow, failed then, failing now.)...whereas a solid but less expensive prop signed from the championship, for example, rather than Carvell might have completed the pre season with us and still turned up next sunday.

It grim, but we need to get our house in order and compete the best we can, we'll find the level we can afford...which will hopefully still be SL, get the full funding, clear the decks, affordable squad and then try to build slowly through the academy, no reason why it can't be done with the right effort. And the league restructure might actually help us in this regard if the worst does happen, at least there is a route back now.

Let Carvell go, use the loan system to get someone in short term, move on. If he's told the club he wants to go the club should get in front of the story and use it as an example of us cost cutting...might help with the rfl.

If you get Pitts in return this is one Hull fan who will be gutted. He does an awful lot of things very well. Too light for prop but a very good second row!

If the Bulls are trying to renegotiate TUPE'd contracts with existing players or staff we should be very concerned. That rumour seems to be gaining currency so it's imperative that the question is asked.... And hopefully answered.

More and more negative news coming out of the club. Is the Hull Daily Mail right in suggesting that Carvell can walk away from his contract when OK Bulls went into administration? Surely the club would have had him sign on to the new regime? Perhaps that why he was missing on Sunday?

To be honest, after the fans forum - and that was of course even before the latest administration - when we were bluntly told that we don't [iwant[/i to lose players but any that want to look elsewhere were free to do so, I'm quite relieved how many of our players we still have.

If Carvell wants out - bye. I didn't think he was like that, but if he is, I won't lose any sleep. I just want players that ARE committed to the team and the club in the face of our dire predicament. Not ones who just provide soundbites valid only till something better turns up. We'll see and if he is that rare thing, a man of his word, there's no problem and he will reject all overtures. It's correct to say he didn't [ihave[/i to accept the 'new employer' and could have walked away after the buy out. This is the case for any employee in that situation. What is puzzling is that we had a statement [or was it just the T&A report? which used the past tense in a sentence about the staff, with the words 'tuped across' in it. I think there is a fortnight's 'thinking time' but I guess that once you've agreed to it, you can't go back on it later, and the report suggested they [ihad been[/i tuped.

It is actually quite important as it would mean we wouldn't be entitled to ask a fee for the transfer.

Request for information on tupeing of players to a newco please.

First of all is Newco obliged to take all players over? certainly the existing contract terms stay, hence Platt on a lot of money last year, but does the RFL require all players to go across to prevent newco cherry picking?

and point two: in these circumstances do the RFL rules include an embargo on other clubs cherry picking players from those tuped by newco, ie could Koppygate be followed by Carvellgate? it would seem inequitable for newco not to be able to cherry pick but other clubs have a free hand to do so at no cost.

I remember a few of the Glasgow rangers players left the club in this way at the time of their troubles

Sounds like Andy Clarke's been trying to do some deals but any chance of them being done on the quite has been blown out of the water. I wonder how much Carvell himself knows about all this? Does he want away?

It would be interesting to know if all the players have been all formally TUPE'd to the new company. It would also be interesting to know if the new directors were aware of any players wanting away when they issued the "ringfence" statement.

I personal wouldn't be angry with Carvell if he chose to leave. He signed a contract with us in good faith , he could have gone to a number if other clubs but chose to come to us, I'm sure under the promise that financial issues were behind us. We've gone into admin again and considering our history of players not wen paid,
Maybe he decided he didn't want that risk in his later years.

Basic TUPE regulations that apply are found at regulations 4(7) to 4(11). It's complicated but essentially if an employee objects to a transfer it has the effect of terminating the contract which would have been transferred. That forfeits the right to claim dismissal except where there is a substantial change in the working conditions.
The regs are written as if an employees objection must be made before the transfer but cases have shown that when an employee does not know until after the transfer ,an objection is allowed. There's no hard and fast time limit.
Two obvious questions-
Has Carvell made an objection and is he the only objector?
Has there been any move to make "substantial change" to working conditions?
