| I'd be massively surprised if the ruling didn't go for Cas and RL, although you never know. With what happened with SBW and just from a common sense and the protection of a sport in GB point of view. You just can't retire from one form of Rugby to play another , just to get around your contract.

The Establishment v Rugby League, it already sounds iffy.
Those nice Union boys with their old school ties, we haven't got a prayer.
Some may say that we have a chip on our shoulders but, it didn't get there by itself !

| If Sale were one of the clubs that made an offer for Solomona (whilst he was still at Cas) then surely they established a precedent by putting forward a compensation offer (transfer fee) to be followed by a player contract. Can't see how this won't be a consideration as it was surely a motivational driver in the players decision to later walk out on his RL contract.

By all accounts we (Tigers) had 3 offers for DS - all turned down. Sale, Gloucester and Warrington although none have been made official by the club.

Well they have the same Establishment in France and the SBW case went the way of the Bulldogs. Also though Solomona's tried it on with the retirement bull, we've got previous Precedents set of fees between the Codes. Like I said you never know though.

Did it? I maybe misremembering things but I thought SBW paid Canterbury his transfer/release fee from his own pocket, well he borrowed the 750,000 from mundine.

I couldn't remember how it all went down and didn't pay much attention after he left tbh. I got that info from Wiki. Where it says-
Quote Williams was eighteen months into a five-year contract with the Bulldogs, and the dispute was only resolved when Toulon paid a transfer fee of around £300,000 (A$750,000)'"

| My understanding is that Castleford will claim a financial loss of £400k.
This is made up of the potential loss of transfer fee (based on the offers received), the additional wage paid to Solomona during 2015 on the basis of the 'extended' contract which he did not fulfil and the loss of direct player sponsorship.
I think Cas are pushing the limit, but that's what happens in cases such as this.

To score a try you have to be given the ball. That doesn't happen for a RU winger very often in a game as Charnley is finding out. How many has he got so far? I reckon they will both be back in RL within a couple of seasons.

| Given CAS reduced Maria Sharpova's suspension from tennis despite the overwhelming evidence given by WADA she was even more complicit/responsible for taking a banned substance it's impossible to say how any ruling might turn out. They are known for some bonkers decisions.

But Castleford are taking this through an Employment Tribunal, not the Court of Arbitration for Sport.

The Aviva Premiership website had this telling quote...
Quote Sale Sharks are aware that Castleford Tigers and the RFL may be looking into legal process and until this is finalised Denny will not be available for media interviews.

| It sounds very much to me, especially from Sale's comments today, the they know they will end up writing a cheque to Castleford and always expected to but are just indulging in a bit of brinksmanship

I really really hope the RFL and Cas take Sale to the high court, legal action just against Solomona is not going to stop this happening again, Cas can start by sticking an injuction on Sale!

I can't believe for a minute they haven't had the conversation with the player, given that he could end up personally liable for a 6 figure compensation payment to Cas; if Sale are absolving responsibility for that and leaving it up to the player, either him or his agent must be as thick as mince.
What's much more likely is that they've agreed to cover any compensation awarded to Cas, but are obviously not going to say that publicly.

Cas have issued High Court Proceedings against Denny himself for breach of contract, and then against Sale Sharks and his agent Andy Clarke (Phil Clarke's brother) for inducing breach of said contract.

| I like this bit - "The idea of losing the player was not welcomed by us and we have repeatedly told Sale Sharks that it would be impermissible for them to talk to Solomona let alone sign him. Clear unequivocal warnings have clearly been disregarded".
Sale were warned not to proceed in the signing. It looks like we have just been waiting for today's announcement of a 3 year deal to bring this out. Very professionally done by the Tigers.

Being a Trinity fan, I've never sided with Cas over anything in the past but, I'm sure that the whole of the RL world wants a positive outcome for Castleford on this one.
It's bad enough when south seas players get "homesick" but, this is on another level and I hope that Cas are abel to get some remuneration for their player going over to the "dark side".
I can only imagine what the Cas fans are thinking about this.
