Quote In light of the Crusaders administration the RFL are set to announce that the 2012 licence system is to postponed until 2015 so the current 14 SL clubs can stabilise.
Fear that Cas or Wakey would take RFL to court if they lost their licence ahead of Crusaders has seen the RFL backdown.
The RFL are keen to see the Welsh team stay in the elite division so it seems sensible that this postponement happens.
Fev and Batley have already withdrawn their applications upon being told while other clubs speak to the legal representitives.
It is thought Widnes are very angry at the news but at end of the day it does seem that the RFL have taken the sensible decision in the current financial climate.
Reports in todays Yorkshire Sport and several other papers say the RFL will allow all the clubs who have qualified to apply in 2012 will all be able to apply in 2015. '"
Not a surprise at all. I can't see Steve O'Connor sticking about if true!

Tbh mate no, but as is mentioned on your board we could jointly (+ Barrow?) sue them equally!
I get the feeling the RFL has made too many promises to various clubs this time, I.e. Achieve X, Y & Z and your up / safe. The only credible option would be to swap Widnes & Crusaders and let them build a WELSH club in the Championship, unfortunately though that is seemingly the least likely option (no surprise there).

| I would welcome legal action, if only to see the RFL attempt to justify their decisions and the language in the documents they have released. For the welsh team, I think letting them 'build' in the Championship would just end up the same as last time. A load of quota exemptions and their own salary cap which would lead to them signing a load of has been Aussies.

Could this be the start of the much vaunted revolution that some people are desperate for.
You could see Widnes with maybe Fax and Barrow taking legal action. The RFL threatning exemption from their competition if they proceed and maybe Leigh jumping in alongside ourselves to form a breakaway..
Or
SOC would simply walk away having learnt a very valuable lesson about a group of men with no integrity whatsoever.

| It doesn't suit us at all. Connecting our club to this sham serves only the RFL, and I sincerely doubt even they would resort to this.

| I agree with vikings fan.I rather Widnes fold than to be an expansion and play in Wrexham.I do not go to watch Widnes rugby union so if Rfl lose the heartland teams, rugby league will die.I am based in Gloucester and would start watching union and football. To be honest this is all rumours and we will all hear more bull, from now till franchise time.Alot of these rumours spread come from fans from clubs in danger such as Cas,Wakey etc.To be honest i am laughing at all this bollox.

Every penny spent on 2012 bid including promo work based on that, some SL clubs could do the same stating it cost more to force stadium plans through at this time etc.

That's what they would look to recover.
But what would the claim be? Breach of contract? Breach of warranty? What?

Good point to raise. I would hazard a guess it would be a breach of contract - if there is any agreement that has been made over the actual decision making process. The RFL have committed to promoting a team from the Championship that meets the criteria.
This is an extract from the Operations Rules ( www.therfl.co.uk/licensing):-
In order for a Championship club’s application to proceed to assessment by the RFL, an applicant must meet the Championship club minimum criteria.
These minimum criteria are:
a. Club has reached a Championship Final or won the Northern Rail Cup in 2009 or 2010.
b. Club has a stadium with an operational capacity of 10,000.
c. Club has turnover of at least £1,000,000 in financial year ending 2009 or 2010.
d. Club has an average attendance of at least 2500 in 2009 or 2010.
Provided at least one applicant meets the minimum criteria, a Championship club will be awarded a Super League licence for a three-year period commencing at the start of the 2012 season.
This initial successful Championship club receiving a Super League licence will be announced in March 2011.
Not sure if the bits in bold contradict each other slightly. The former refers to meeting minimum criteria and proceeding to assessment whereas the latter suggests an award will be made based on the minimum criteria.
"The independent RFL Board will determine who gains membership to the Super League in 2012."
I don't know what else is in the Operation Rules with regards to a club being prevented from taking legal action nor them blocking license applications for 5 years. I'm not a lawyer but applicant clubs are relying on the RFL board to act independently and impartially in making its decision. It's all in the words used and judging on the above example it is all a bit too wooly for my liking.
