Of course it would as they are linked to one of the clubs affected by the outcome. But in the same way they shouldn't be using a firm that has links to the actual club involved in case either! It matters not whether they have used this firm on many occasions over a period of time, for this particular case they should have looked elsewhere. A simple google search brings up plenty of law firms in Yorkshire that could have done the job equally as well and would have appeared to all to be truely independent, by using this firm it gives the opposite impression. They really don't help themselves.

Wakefield Trinity Wildcats chairman Mike Catter has announced that the club is to appeal against the points deduction imposed by the RFL for going into administration in 2012. In a statement issued this morning by Catter, he stated that the club are to pay for the services of an independent panel, appointed by the RFL, to look into the matter.
Catter stated to waiting journalists "We believe the club was treated unfairly back then, and believe that we have good grounds for launching an appeal".
If successful, the 4 points that were deducted at the time, could be added to the clubs tally for this season.
In reply to Catter's statement, RFL Chief Executive Neil Wooden stated "Although Wakefield are not an iconic club, they are perfectly within their rights to appeal against the decision. We offered them the services of a totally independent, non-biased panel comprising of Mr Marc Green from Bradford, Mr Jack Fulton from Castleford and Mr Gus Mackay from London, but they have decided to pay for their own independent panel comprising of Mr N Fox, Mr C Brereton, and Mr P.Townsend all from Wakefield."
Extensive enquiries carried out by this publication have revealed that the selected individuals work for Wakefield-based legal firm "Topliss, Fox, Poynton and Demetriou".
We contacted this company and spoke with Mr N Fox who stated that although he had never heard of the Wakefield Trinity Wildcats, or even Rugby League, he was delighted that his independent company had been chosen by the club, and that they would act with utmost integrity in independently assessing the facts that they were being paid a handsome sum to assess, and would independently arrive at the right decision for the club, whom he had never heard of.
We tried to suggest to Mr Wooden from the RFL that for a Wakefield-based legal firm to be placed in charge of this matter could be seen by some as hardly being independent, but his secretary stated that Mr Wooden had retired for his usual 3 hour lunch break, and had gone for "a pie or two".

I'd love to see the interpretation of independent they used then.

| If the Bulls get points back and MC wants to legally challenge it could he ask whomever it was from the RFL who stated we'd be relegated to confirm or deny the conversation in an afferdavit. If they deny it and MC knows it to be a lie then at least we'll know where we stand.

| You could call it "A conflict of interests" we were docked 4 points for going into admin I expect no less for Bradford who went into admin a second time.Just maybe if the RFL had let Bradford flounder the first time like they did with us then we wouldn't have had this situation and things would have been sorted.

none would have been anywhere near as familiar with RFL regulations as the only company charged with interpreting them for the last 8 years.
They are the RFL's legal arm. ALL legal work goes through them (and farrer and co)
Your point misses the fairly obvious problem that ANY sports law firm familiar enough with the RFL's regulations to adjudicate on this matter, would have links with the RFL and other RL clubs. There isnt a firm out there with a department set up, just reading RFL regulations and interpretations without dealing with RL. To gain the experience necessary they would need have dealt in such cases and would always, necessarily have those links.
To ditch your retained legal firm, to pick up another, with existing links to other rival clubs (which is the only other option) would have been far worse.
for example, Chadwick Lawrence have previously worked with WTW and Huddersfield Giants,
Walker Morris senior partner and one in charge of sports law is Chris Caisley former bradford bulls chairman
Farrer & CO also work in conjunction with PinsentMasons for the RFL

You beat me to that one. I very much doubt that it's beyond the ken of most law firms with any credibility to unravel the relatively simple rules governing RL; and given the serious implications of the outcome and the number of lives and livelihoods affected, it seems reasonable to make the 'independent' panel genuinely independent - if for no other reason than to silence the doubters.
Unless of course the combination of blunders and amateurish scheming that have characterised this whole affair will intentionally be covered up? After all, if you're the RFL's 'legal arm' and rely on that status for a significant fee income, it's not in your interests to expose any inconvenient truths - is it?

| I think Bren has hit the nail on the head.
The RFLs brand of Independent people are fully aware of how much of sham the game of RL is and how its run, its people arent going to blab.
A truly independent panel would simply run away from the car crash screaming and that wouldn't be good for the administration would it.
I think the whole game would be called into dispute!!

It comes down to how much the RFL want it to be worked out and equally if they want this to then become public knowledge.

Spot on. Any law firm which deals with sport specific cases will be more than capable of reading through a governing bodies rules & regulations and apply them to a case, thats exactly what they are paid to do. To try and suggest otherwise is nothing short of laughable. This particular firm should not have been used in this instance, it's as simple as that.

| I wonder if the term "independent panel" should be rephrased to an agree arbitration body? It sounds relatively balanced with someone on the panel familiar with the Bulls and one familiar with The RFL.
For an arbitration process to work both sides need to be in agreement that they are happy with the people sat on the panel of judges and willing to accept their judgement. Otherwise I suspect one or the other of the parties would have not gone ahead until they had a panel both agreed with.

With both parties probably hoping for the same outcome I don't think they really need to worry about any conflicting interests.
