Some clubs were not up to the salary cap levels and never have been. Quins for one.
At Wigan, Dave Whelan wouldn't allow the club to go anywhere near image rights, ebt's ebpt's. He may have relented in the last two years over image rights. Ian Lenagan has said on a number of occasions that Wigan's exposure to HMRC is very minimal. No doubt due to DW's decisions.
This did put Wigan at a competition disadvantage as numerous execs used to tell us. It would also put those clubs at a disadvantage who weren't up to the SC levels.
I do hope that Leeds win the case v HMRC but the idea that the tax man would come after clubs for £ms doesn't bear thinking about!
