Like all such decisions it's what is referred to as a 'judgement call' from the ref. At the end of then day that's what he is there to do but when we come down to 'intent' it does get a bit difficult, even when you have video evidence to look at, but the poor old ref (admittedly with the help of a touchie) has to make his mind up pretty quickly so it's hardly surprising we get some controversial decisions.
