The criteria in the article is simple the criteria they have to meet to apply. That is not the criteria they will be judged upon if they are allowed to apply.
Surly if all the current Super league clubs get at least a C grade (belive to be 4 points) on the license applications then how can they be replaced with a club from the lower league with only three points per say?

If say Cas and Wakey get foundations laid on the staduims and start to build then they must have a greater case to stay in Super league than say Widnes who will not have a competitive squad etc and therefore not tick that box on the criteria.

You've got that very wrong in my opinion. A Championship Club will be told in March 2011 that they are in (if they fulfil the 5 criteria). Following that decision all other teams have to submit an application by April 2011. So Championship clubs will not be judged on the same criteria as SL clubs unless they apply in the April tranche. I think that will be the RFL get out of jail card to put Toulouse in having granted Widnes a licence in March.
